Component of a Demand Letter This letter must be sent by certified mail, return receipt requested The first paragraph of your demand letter explains the purpose of the letter, i.e., a demand for settlement, and the amount requested in settlement. This paragraph deals with the liability of the party to whom the letter is addressed. Some attorneys would list the contentions of the person who is sending the letter and sometimes it will also present the contentions of the person to whom the letter is being addressed. This paragraph (which could be more than one) outlines the injuries of the plaintiff (defendant) and the damages which have occurred. This is normally the conclusion, which could also be a summary of the previous paragraphs. It explains why the case should be settled at this time, for the amount presented in the first paragraph. You ought to review the points in the letter to ensure that the amount of the settlement requested is consistent with the damages, circumstances, and liability discussed.
